Abstract 

In light of the urgent need to address climate change and the geopolitical impacts of the Russian invasion of Ukraine, the development of offshore wind and green hydrogen projects has accelerated significantly. These large-scale renewable energy projects are capital-intensive, requiring collaboration among developers to mitigate risks and pool resources effectively.

In their latest article, Tukun and Herrera Anchustegui delve into the complexities of collaboration in renewable energy projects within the framework of European Union competition law. The authors provide a detailed analysis of the interaction between entities involved in these projects and the legal boundaries they must navigate.

Drawing from the Norwegian offshore wind licensing rounds, Tukun and Anchustegui examine how competition law influences collaborative strategies for securing licenses. They focus on joint bidding practices under Article 101 of the Treaty on the Functioning of the European Union (TFEU) and merger control rules, assessing the legality and potential anticompetitive effects of joint ventures and collaborative agreements.

Their findings suggest that, generally, such collaborations are pro-competitive, advancing sustainability objectives as long as the cooperation remains within necessary limits.
